Gay teacher sued employer after getting fired for sexual orientation

自2018年明珏提起诉讼以来,同志教师劳动权第一案逐渐进入人们视野。本文将本案的主要的时间线以及现有的报道进行汇总。

Since Mingjue brought a lawsuit against his employer who dismissed him due to his gay identity, this first landmark case related to gay teacher’s equal rights to work has been introduced to and known by the public. This post is going to review the important events and list reports and comments from media.

2017年/2017

2017年,投资人魏文全找到明珏,问他要不要一起开一家幼儿园,由魏文全出资。这是魏文全第一次投资幼教机构。2017年10月23日,萌宝王国正式登记成立。除了明珏,魏文全还找了另一个负责招生的老师,三个人共同担任萌宝王国的合伙人。2018年3月正式开放学生入园。(来源:好奇心日报

In 2017, Mr. Wei Wenquan met Mingjun and asked if he wanted to open a kindergarten together, which was funded by Wei. On October 23, 2017, Mengbaowangguo was officially registered and established. While Mingjue was in charge to the course and teaching, another teacher was responsible for recruiting students. In March 2018, the Kindergarten welcomed its first batch of students.

2018年7月28日,明珏受邀参加同性恋亲友会(山东临沂分会)的二周年庆,他还带着母亲一起参加,分享自己作为同性恋者的经验。(来源:好奇心日报)

On July 28, 2018, Mingjue was invited to attend the second anniversary of the Shandong Linyi Branch of PFLAG (short for Parents, Families and Friends of Lesbians and Gays of China). He also took his mother to participate the ceremony, where he shared his experience as a gay.

2018年8月5明珏转发了上述活动的文章到朋友圈,标题中带有“我是同志我骄傲”字眼。家长看到后引发不满,向幼儿园投诉,甚至要求带孩子去验血。(来源:济南时报)

On August 5, 2018, Mingjue shared the article about the ceremony above, with the words “I am a gay and I am proud” in the title, to Moments of his WeChat. Parents of kids complained to kindergarten and even asked to take their children for blood tests.

2018年8月6日/August 6, 2018

魏文全称第二日和明珏沟通,让其做出选择,要么作为教师身份,就不要推广个人偏好,要么就辞职。最终明钰写了辞职信,表示“因本人个人原因提出辞职”。明珏证实了这份辞职信的存在,但认为由于辞职不是自己主动提起,这实际是“变相解雇”。(来源:新京报)。

Wei said that he communicated with Mingjue the next day and ask him to make a choice, either as a teacher and never to promote personal preferences, or to resign. At last, Ming Yu wrote his resignation letter, expressing that he had resigned for personal reasons. Mingjue confirmed the existence of this resignation letter, but claimed that as he was forced to resign, it was actually “disguised dismissal”.

头条新闻在微博发起了“如果你是孩子的家长,知道老师是同性恋是否能接受?”的投票。本次共有8万网友参与投票,92.6%的人表示能接受,5.7%的人表示不能接受。来源:头条新闻

In a vote carried out on Weibo, more than 80,000+ people voted, with 92.6% voted that they can accept their children’s teacher is gay and 5.7% voted no.

本案入选2018年度中国十大影响性诉讼社会法领域候选案例。理由本案是“是性少数群体就业权的典型,……,该案的审理裁决有力地维护了这一群体的利益,为之后的裁决提供了优秀先例。”来源:中国法律评论

The case was nominated for China’s Top Ten Impact Litigation in 2018 by China Law Review and was commmented that “this case is typical of LGBT+ people’s equal rights in workplaces… and provided references for cases in the future. ”

2018年9月19日/September 19, 2018

2018年9月19日,明珏往青岛市劳动人事争议仲裁庭递交了一份申请书。随后,他在庭外手举一张写有:“我教导孩子要诚实,所以我无法说谎。我是同性恋。”的标牌。(来源:济南时报)

On September 19, 2018, Mingjue submitted an application to Qingdao Labor Dispute Arbitration Commission(hereafter “the Commission”). Later, he held up a sigh that said “I teach my children to be honest, so I can’t lie. I’m gay.” outside the courtroom.

2018年9月27日/September 27, 2018

青岛市劳动人事争议仲裁委员会正式立案。明珏收到了仲裁庭的通知书。通知上写着开庭日期、地点与 “赔偿金” 事由。

The Commission officially confirmed the filing of this case. And Mingjue received a notice said the date, place and main points of the hearing.

青岛市劳动人事争议仲裁委员开庭审理本案。

The Commission heard the case.

2018年11月22日/November 22, 2018

仲裁委作出劳动仲裁裁决,明珏胜诉。裁决书上显示魏文全需支付明珏工资差额,意即一共6个月的工资,除此之外驳回其他仲裁请求。

The Commission ruled in favor of Mingjue. The judgment showed that Wei should pay Mingjue six months’salary. Other requests were rejected.

最高人民法院在“一般人格权纠纷”中增设“平等就业权纠纷”案由(参见法信网站

The Supreme People’s Court added a new type of dispute called “disputes over equal rights to work” within “disputes over general personality rights”

2019年1月10日/January 10, 2019

明珏于以平等就业权纠纷为案由向法院提起诉讼并获受理,将于2019年2月27日开庭审理。

Mingjue filed a second lawsuit using the new legal cause–equal right of employment and was confirmed. The trial will be held on February 27, 2019.

2019年2月27日/February 27, 2019

当事人被法院告知,平等就业权诉讼延期审理,等待原劳动争议案件结果后继续审理。 The hearing was suspended pending for the result of the employer’s appealing against the Labor Arbitration Commission’s decision.

2019年5月13日/May 13, 2019

当地法院审理了对方雇主的上诉,但是未当庭宣判。 The local court heard employer’s appealing and didn’t make judgment at court. ……
